Rental Agreement
These terms and conditions are a legal agreement between you and Dress Desire. The terms and conditions are established by us, and you use the services that we provide, which you submit your personal information, order our products, and obtain related services from Dress Desire via www.dressdesire.nz
Please read these Terms of service carefully before accessing or using our website as you agree to be bound by these terms of service by accessing or using any part of the site.
General – Rental Agreement
The agreement you have with Dress Desire is a rental agreement. This means that your right to the products on our website are subject to the rental agreement which are in your order including the dates for the rental, the price and the date by which the goods are due to be returned.
All Prices are in New Zealand Dollars (NZD).
Rental Fees
The rental fee will be stated along-side the information required for each product which will be listed on the website, the rental fee does not include postage costs. This will be charged at “check-out”. In submitting your order, you hereby authorise us to charge your account used for payment for the rental fee and postage costs. This charge will occur immediately. Failure to return the goods or the goods are returned in a unusable state you hereby authorise Dress Desire to charge your account used for payment a charge of 150% of the retail value of the product rented from our website. This 150% of the retail value will be taken from original recommended retail price (RRP) when first released. This covers the loss of the item plus the expected loss of revenue from further rentals of that product. A refund or store credit may occur on the obligations that the dress you had booked becomes damaged from a previous customer meaning your rental will not go ahead. Dress Desire has a strict no cancellations policy so please ensure you are certain about your order. Should there be an issue or error in your order it is your obligation to contact Dress Desire within 24 hours of receiving the item to change any details. We are sorry but we do not refund or credit if an item does not fit you. We allow try on's for our Tauranga customers but cannot post items to try on. Dress Desire reserves the right to charge your account used for payment for non-compliance of the rental agreement and terms and conditions under which you hire our products.
Your obligations
If you require the garment to be posted you must provide a physical address where you are able to physically accept the parcel. Should you provide an address where you are not personally present, Dress Desire will not be liable for non-delivery of a parcel or the result of a parcel being left unattended. Upon confirmation of the products you agree to treat the garment with care so that there is no damage to the product.
Please do not wash any of our garments as most of them require dry-cleaning.
You are hereby financially liable for loss, destruction or damage to the goods due to theft, disappearance, fire, major stains, or any other cause in which the goods are rendered unusable for further hireage.
If on return, items need cleaning beyond standard dry cleaning or repairs you will be liable for these costs and will be charged appropriately.
When booking your rental date please ensure you select the date you would like it to arrive and the return date of the next working day. Please book at least 2 days in advance before the day you wish to wear the item to ensure that we have received your payment, and that we have enough time to post it to you. If you are planning on picking up an item you may book it on the same day you wish to wear the item, however, proof of payment is required.
Under this agreement you agree to return the products to Dress Desire immediately after your hire date (posted via courier the following working day, in the bag supplied).
If you have picked an item up from our physical address in Tauranga, it needs to be returned on the next working day.
If you return the goods late, a late fee of $25.00 per day will be charged to your account that you made the payment with, up to a maximum not exceeding 150% of the retail value of the goods hired. If our product has not been returned to us within the 14 days, this non-compliance of return will be considered as a breach of the rental agreement and Dress Desire shall have the right to charge your credit card 150% of the original retail price (less any late fees that have already been paid).
You are solely responsible for the goods being returned on the agreed date.
Should you dishonour this agreement and not pay the amounts due for any late return or damage to the goods, we will initiate enforcement procedures under this agreement. Should enforcement procedures be initiated we will claim all costs for the garment against you including all solicitor fees applicable on a client solicitor basis.
Dress Desire’s commitment to you
Once your order has been confirmed, we will uphold the agreement by delivering the product you have ordered, in the correct size, pattern, colour and design, on the date requested to the address you have provided in the order. If the product arrives and it is not of the requested colour, size, pattern and design you must contact Dress Desire within 24 hours of the date you received our product (to ensure it has not been worn) and return the product in the prepaid bags provided in the order date to ensure you receive a refund or store credit if desired. Or we can attempt to find a suitable replacement for the original goods requested by the rental date. reimbursements will not include any shipping costs. Dress Desire holds no responsibility for errors of your own when ordering products such as, but not limited to requesting incorrect sizes, prints, design and colour, Dress Desire holds no responsibility for these mistakes.
We make sure that all products match the quality level that we have described our products to be at, clean and ready to wear. We inspect our items carefully before sending them away, however if you receive the item and it is not up to the standards outlined please contact Dress Desire within 24 hours of receiving the items. We don’t guarantee that we will receive your returned item. You are liable for any products lost or damaged in transit on there return, and will be charged accordingly.
Limitation of Liability
Dress Desire holds no liability to you or any other third party, for any unforeseen circumstances or circumstances considered force majeure, that result in any damage to the item, non-delivery, or loss of item. You solely hold responsibility for the item during the rental period, if any damage and or claims are made against you as a result of occurrences that happened while you were responsible for the item regardless of whether or not they were your own doing or out of your control, you will be held solely responsible for the costs incurred.
Postage
Dress Desire take no liability should an item not arrive to you on time due to an issue with postage. We try to post all our items 2-3 days prior to ensure you have your item on the day you have requested it for. If an item does not get delivered on time we will offer you a credit for the amount of the item you have booked, but not for any postage costs. If the order has been placed on Thursday night, or Friday day for the Saturday rental, we do not issue refunds if the order does not arrive on time. This is because we weren't given enough notice to ensure it would arrive to you on time.
We always ship via overnight courier, however NZ post does not give us a 100% guarantee, therefore we are unable to give you a guarantee.
Changes To Terms Of Service
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
Billing And Account Information
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
Refunds
Refunds are only applicable when the garment arrives damaged, or stained or does not arrive to you in time, due to problems on our behalf. Otherwise no refunds are given.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment.
